Isn't this basically what Microsoft is doing? I'm pretty sure they make about $15 from each Android device sold from HTC, Samsung, etc. which is why they make more money from Android than from their own operating system.

I've heard that Microsoft collects anywhere between $5 and $10 on most Android phones. I'm not crazy about having to pay apple for most of these ridiculous patents but with Google absorbing Motorola's patent portfolio, at least now they can sit down and work out a deal. Up until now, Apple wouldn't even discuss any kind of settlement and was simply trying to block out all competition.

And Apple paid Nokia €800m and further royalties of €8 per iPhone sold in the future.
I think Nokia settling the suit unfortunately has given Apple leeway to go on more spurious attacks without worrying about its back as much.

Microsoft collects money under the Android column as part of the deal they make with the likes of Samsung that gives Samsung money for licencing hardware patents etc. and as a rebate on supporting Windows device production etc. I doubt much if any money actually changes hands but it makes for fun PR.
