Companies need to be hit hard to prevent outrageous behavior like anti-poaching collusion. They want a "free market" that applies to only their side of the transaction. Truly free markets must be free for buyers (employers in this case) and sellers (employees). Both sides must be able to transact with whoever is willing to take the best price. ?
