A case can certainly be made that drivers should try to avoid potholes. However, when they are as prevalent as they are in Michigan right now or when they are camouflaged by melt water or rain, it's just not practical, especially if there is other traffic around you. If your car is damaged, and you can do so safely, it's  probably a good idea to snap some photos of the area when an incident happens to back up your story.?
